NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
OPEN ONLY TO ELIGIBLE LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO, AS OF THE TIME OF ENTRY, ARE AT LEAST 18 YEARS OLD.
VOID IN PUERTO RICO AND ALL JURISDICTIONS OTHER THAN THOSE STATED ABOVE AND WHERE PROHIBITED OR RESTRICTED BY LAW.
1. Eligibility
The PrimaFoodie “Wellness” (the “Giveaway”) is open only to individuals who (i) are eighteen (18) years of age or older at the time of entry and (ii) are legal residents of any of the fifty (50) United States or the District of Columbia. Void in Puerto Rico and all jurisdictions other than those stated above and where prohibited or restricted by law. Employees of PrimaFoodie LLC (“Sponsor”), their affiliates, subsidiaries, and agencies (collectively, the “Promotion Parties”) and their immediate family members and/or those living in the same household of each are not eligible to participate. By participating in this Giveaway, entrants agree to be bound by these official rules (“Official Rules”) and by the decisions of the Sponsor, which shall be final in all matters relating to the Giveaway.
2. Giveaway Entry Period
The entry period for the Giveaway starts on February 23, 2022 at the time of post by Sponsor and ends on February 27, 2022 at 11:59:59 PM Pacific Standard Time (“Entry Period”).
3. How to Enter
NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE IS NECESSARY TO PARTICIPATE.
You may use the following method to enter the Giveaway:
Step 1: Follow @primafoodie on Instagram.
Step 2: Tag a friend in the “Wellness” official giveaway post.
Step 3: Submit entry through tap.bio/@primafoodie link. By completing the Giveaway entry form, participants agree to receive updates from PrimaFoodie.
You may obtain a maximum of one (1) entry to participate in this Giveaway.
Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules.
4. Drawing; Winner Selection and Notification
On or about February 27, 2022, a random drawing will be conducted by Sponsor to select four (4) winners from among all eligible entries received during the Entry Period. Odds of winning depend on the number of entries received. Winners will be determined at random by PrimaFoodie. Potential winners will be notified by PrimaFoodie via email, and must sign and return any required Affidavit of Eligibility and Release within twenty-four (24) hours of the date notice is sent or such other date set by Sponsor to claim their prize. Failure to respond within the applicable time period will result in forfeiture of prize and Sponsor shall have the option to award the prize to an alternate winner. The return of any prize notification or prize as undeliverable may result in disqualification and an alternate winner may be selected.
5. Prizes and Prize Claims
Four (4) winners will win one (1) prize, which is a gift package consisting of the following items, with approximate retail values (“ARV”) in United States Dollars of each item as follows:
One (1) Scalp Oil Treatment ($30.00);
One (1) The Tea Project Pink Moon Calming Wellness Tea ($18.00);
One (1) Beekeeper's Naturals B.Immune Throat Spray ($13.99);
One (1) Box Rae Wellness Focus Drops ($14.99);
One (1) Wildling Empress Stone ($65.00);
Three (3) Tallowderm Products Including Skin Balm ($34.00), Travel Size Skin Balm ($7.00), and Soap ($7.00)
The total prize value of all items provided for each prize is $189.98. The sum total prize value of all four prizes collectively in this Giveaway is $189.98 x 4 = $759.92.
Limit one prize per family or household. No substitution or transfer of prize permitted by winner. Sponsor reserves the right to substitute a prize of equal or greater value, as well as any of the above items comprising the prize.
The winners are solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of a prize. All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of the winners.
As a condition of receiving the prize, the winners must provide Sponsor with a valid mailing address and contact information. Sponsor will pay for the cost of mailing the prize to the winners. The method of shipping and the carrier will be determined in the sole discretion of Sponsor. All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of the winners.
All prizes will be awarded. If a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded.
6. Publicity
Except where prohibited by law, by accepting a prize, the winners hereby grants Sponsor and its licensees a perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display the winners’ names, image, hometown, biographical information, and likeness in any way, at any time, in any and all media, including for use in advertising and marketing, without limitation, without any additional approval or consideration.
7. Limitations of Liability
By entering the Giveaway, entrants hereby waive all right to, and release and hold harmless the Promotion Parties from, any actions, claims, liability, damages (including punitive, incidental and consequential damages), losses or injuries of any kind, or expense (including attorneys’ fees) (collectively “Claims”) arising out of or in connection with participation in the Giveaway and/or the receipt, acceptance, use or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Promotion Parties will not be responsible for Claims relating to: (i) technical, hardware or software malfunctions, the malfunction, unavailability, or loss of any computer, telephone, network, satellite, hardware, software or communications line or connection, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Giveaway; (ii) unauthorized human intervention; (iii) late, incomplete, incorrect, delayed or inaccurate entry transmission and/or winner notifications; entrant’s failure to receive prize notices due to entrant’s spam, junk email, or other security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; prize claims or other information or communications relating to the Giveaway, or the failure to capture or transmit any such information; (iv) damage to any person’s computer or mobile device; (v) by any human error which may occur in the processing of the entries in this Giveaway; or (vi) any errors (whether typographical, technological, or otherwise) in these Official Rules, the publication of the offer, the administration of the Giveaway, winner notifications or other announcements or communications relating to the Giveaway. If, in the Sponsor’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Giveaway, or if technical difficulties (including viruses and bugs) compromise the integrity of the Giveaway, Sponsor reserves the right, in its sole discretion, to cancel or modify the Giveaway, and/or clarify or modify these Official Rules however it deems appropriate to correct any such ambiguity or error(s) in a manner Sponsor deems appropriate. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form. If due to an error or for any other reason, more legitimate prize claims are received than the number of prizes stated in these Official Rules, Sponsor reserves the right to award only a single prize from a random drawing of all eligible entries. In no event will more than the stated number of prizes (i.e., one prize) be awarded.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Sponsor may prohibit an entrant from participating in the Giveaway or winning the prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Giveaway by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or any Promotion Parties.
8. Sponsor’s Reservation of Rights
Without limitation to Sponsor’s rights to discontinue or modify the Giveaway for any reason, if the Giveaway is not capable of running as planned for any reason, including without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Giveaway, Sponsor reserves the right, at its sole discretion, to modify, suspend, or cancel the Giveaway. All Giveaway materials are subject to verification and are void if (a) not obtained through legitimate channels in accordance with these Official Rules, (b) any part is counterfeited, altered, illegible, reproduced, tampered with or otherwise irregular, (c) obtained where prohibited, or (d) they contain printing, typographical, mechanical or other errors.
9. Governing Law
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of entrants and winners, all matters arising out of or relating to this Giveaway and these Official Rules, and the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules. Entrant further agrees that any legal suit, action or proceeding arising our of or relating to this Giveaway and these Official Rules shall be brought exclusively in the applicable federal or state courts located in the County of Los Angeles, State of California.
10. No Waiver/Severability/Right to Modify or Discontinue Giveaway
Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. Sponsor reserves the right to modify or discontinue the Giveaway at any time.

12. Winner’s List
For the names of the prize winners, available after February 27, 2022 send an email to empowered@primafoodie.com or send a self-addressed, stamped #10 envelope to Sponsor at the address listed below. Requests must be received no later than sixty (60) days after the end of the Entry Period.
